NOTIFICATION

No. RERC/Secy/ Reg. 34 In exercise of powers conferred on it by section 32 read with section 181 of the Electricity Act, 2003, the Rajasthan Electricity Regulatory Commission, after previous publication hereby notifies the following regulations, namely:
1. Short title and commencement: -
(1)These regulations shall be called the Rajasthan Electricity Regulatory Commission (Levy of fee and charges by the State Load Despatch Centre) Regulations, 2004.
(2)These regulations shall come into force from the date of their publication in the official gazette.
2. Definitions: - In these regulations unless the context otherwise requires: -
(1)‘Commission' shall mean the Rajasthan State Electricity Regulatory Commission.
(2) ‘Open access customer' and its categories of ‘long-term' and ‘short-term' open access customer shall have the same meaning as assigned to them in the Rajasthan Electricity Regulatory Commission (Terms and Conditions of the open access) Regulations, 2004.
3. Levy and Collection of fees and charges: -
(1)The State Load Despatch Centre (SLDC) may levy and collect such fees and charges from generating companies and licensees engaged in intra state transmission, distribution and trading of electricity as is specified in these regulations.
(2) The SLDC may also levy and collect such fees and charges as specified in these regulations from other open access customers using transmission or distribution system of the transmission or distribution licensees in the state.
4. Accounts of SLDC: - The SLDC shall maintain its accounts of expenditure and revenue under different heads showing separately charges payable to Northern Regional Load Despatch Centre (NRLDC) and charges for the unified load despatch and communication scheme.
5. Submission of accounts: -
(1)The SLDC shall submit to the Commission its audited annual accounts for the year ending 31st March by November 30 of the following financial year.
(2)The SLDC shall also submit by November 30 every year its estimates of income and expenditure for the following year commencing from first April.
6. Proposals for fees and charges: - Alongwith submission of its statements of accounts, the SLDC shall submit to the Commission its proposal for levying and collecting fees and charges from generating companies, licensees and open access customers.
7. Determination of fees and charges: - The Commission may scrutinize the statement of accounts and the proposals of SLDC for levying and collecting fees and charges and after calling for additional information, if necessary, determine such fee and charges in the manner specified hereunder.
8. Charges on generating companies, licensees and long-term open access customers: -
(1)The Commission may allow reasonable annual expenses of the SLDC to be charged from the generating companies, licensees and long-term open access customers.
(2)The Commission may also provide for a criterion for apportioning such charges amongst the generating companies, licensees and long-term open access customers.
(3) While computing the annual expenses to be recovered under sub clause (1), income from short-term open access customers shall be deducted from the total annual expenses of the SLDC.
(4) The charges determined by the Commission shall be payable in advance in four quarterly instalments.
9. Charges from Short term open access customers: - A sum of Rs. 50,000 per MW per year subject to a maximum of Rs. 5 lakhs per year shall be charged from short-term open access customers, which shall be paid in advance in four quarterly instalments.
10. Fee for preparation of schedule by SLDC: -
(1) If a generating company or a licensee fails to give its generation or drawal schedule as required and the SLDC has to prepare a schedule on their behalf, the SLDC may charge a fee of Rs. 50,000 per schedule for preparing such schedule.
(2)(a) Generating stations with installed capacity of I MW and up to 10 MW shall submit a weekly schedule of generation to the SLDC.
(b) All generating stations with installed capacity of 10 MW or above shall submit daily schedule of generation to SLDC.
(c) The SLDC may charge a fee of Rs. 5000 per schedule for preparing a schedule on behalf of a generating company if such generating company under this sub clause fails to furnish a schedule.
(3) Generating Stations with less than 1MW of installed capacity need not file its generation schedule with the SLDC.
(4) If an open access customer fails to submit daily schedule for drawal of electricity to the SLDC, the SLDC may charge a fee of Rs. 1000 per schedule for preparing a schedule on its behalf.
11. Charges specified by Central Commission: - In case a person engages in interstate transmission in conjunction with intra state transmission, SLDC fees and charges recoverable under these regulations shall be in addition to charges payable for interstate transmission specified by the Central Electricity Regulatory Commission.
