In
exercise of powers conferred on it by Section-57 read with Section 9 and 59 of the Rajasthan Power Sector Reforms
Act, 1999, (State Act No.23 of 1999), section 44 of the Electricity (Supply)
Act 1948, and all powers enabling it in this behalf, the Rajasthan Electricity
Regulatory Commission, hereby makes the following regulations namely:
1. Short
Title, Commencement and Scope:
(1) These Regulations may be called the
Rajasthan Electricity Regulatory Commission (Generation of Electricity) Regulations,
2002.
(2) These regulations shall come into force from the date of their publication in the Official Gazette.
2. Definitions
In these regulations, the words or expressions shall bear
the same meaning as in the Rajasthan Power Sector Reforms Act 1999 and Rajasthan
Electricity Regulatory Commission (Conduct of Business) Regulations, 2000.
3. Consent of the Commission
(1) A person, required to take previous consent under section 44 of the Electricity (Supply) Act, 1948 for establishing or acquiring a new generating station or for extending or replacing any major unit in a generating station, shall do so with prior consent of the Commission;
Provided that no such consent shall be required if the installed capacity of the generating station is 250 kW or less.
Provided
further that a generating company not required to take previous consent under
Section 44 of the Electricity (Supply) Act 1948 shall be required to furnish
copy of Memorandum and Articles of Association, area of activity specified
by the State Government under Section 15A & 18A and copy of public notifications
under Section 28 & 29 of the Electricity (Supply) Act 1948.
(2)
No such consent shall be required in respect of generating stations in existence
on the date of coming into force of these regulations.
(3)
No person shall permanently close down an existing generating station/plant
with an installed capacity of more than 250 kW without previous consent of
the Commission.
4. Furnishing of Information
(1) Information in Form I shall be furnished to the Commission in respect of all generating stations
with an installed capacity of 125 kW or more whether commissioned before or
after coming into force of these regulations. Information in Form I shall be furnished for the year ending March 31, by April 30 ever year.
(2) All generating stations shall
maintain logbook in the form prescribed by the Commission.
5. Procedure for grant of consent
(1) A petition for grant of consent shall be submitted to
the Commission in the prescribed form as per Form A, B or C in six copies.
The petition shall be accompanied with a fee of Rs. 5,000.00 for generating
stations up to 25 MW and Rs 10000.00 for generating stations more than 25
MW
(2) Where installed rated capacity of any generating station
exceeds or is likely to exceed 25 MW, the Commission shall consult the Central
Electricity Authority before giving consent. Hence applicant shall follow
guidelines issued by the Central Electricity Authority. A feasibility report
shall be submitted with the petition.
(3) In case one or more units of the generating station is
to run in parallel with the power system of the transmission or distribution
licensee, acceptance of the licensee concerned shall be obtained by the generator
and appended with the petition. In case an agreement to run the generating station in parallel is entered into subsequently,
the Commission shall be notified of this arrangement within seven days of
execution of such agreement.
6. Compliance with rules and
regulations
(1) All generating stations will abide by the Safety Code and other good practices. A
generating station running in
parallel with the grid will
in addition abide by the Grid Code, Distribution Code, Load Despatch and System
Operations Code, Metering Code and other codes and regulations as laid down
from time to time.
(2) No generating
station running in parallel with the grid shall be entitled to any compensation
in the event of grid failure.
7. Sale or wheeling of energy
Terms
and conditions of sale of electricity to transmission or distribution licensee
or for wheeling of energy on their system or sale of electricity to consumers
shall be as mutually agreed by them except that the tariff for sale of electricity
to consumers or for transmission of electricity shall be as determined by
the Commission.
8. Environmental clearances
The generating station shall abide by the emission
standards set up by the Central/State Governments. The generator will obtain and keep valid all the required environmental
and pollution clearances from the appropriate authority.
9.
Contravention of regulations
Notwithstanding any other
action that Commission may take for contravention of any provision of these
regulations, the Commission may, after issuing a show cause notice to the
person concerned withdraw the consent granted under these regulations.

That I/We shall maintain
the Log Book in the form prescribed by the Commission.
2.
That the supply arrangements
fro the Generating Set(s) shall be got checked and approved by the office
of VVNL/Licensee.
3.
That I/We shall neither
sell the energy generated by me/us nor shall supply the power/energy so generated
even free of cost to others.
4.
That the generating
sets will not in any circumstances be in parallel with the power system of
Licensee/VVNL.
5.
That I/We shall operate
the generating set(s) whenever called up to do so by the Commission or Licensee
for giving suitable relief to the Licensees system by meeting the demand
of other consumers also.
6.
I/We shall not run
the generating set(s) in case my/our supply is dis-connected by Licensee for
any violation of the rules or non-payment of electrical dues.
7.
That the permission
accorded by the Commission does not absolved me/us from obtaining any other
approval necessary like the approval of the Electrical Inspector to the State
Government etc.
8.
I/We shall install
the Generating Set(s) within a period of __________ year(s) from the date
of issue of sanction.
9.
I/We shall send the
monthly data of energy generation in the proforma prescribed by the Commission
after commissioning of the generating set(s)to concerned authorities as directed
by the Commission.
10.
I/We shall comply/
fulfill all the conditions stated above falling which the Commission will
be free to withdraw this permission.
